Terms of Service

Effective April 1, 2026

1. Acceptance

By accessing or using clutchchat.app ("ClutchChat", "we", "us"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service. ClutchChat is operated by ClutchChat Inc., a Delaware corporation.

2. Eligibility

You must be at least 13 years old to use ClutchChat. By creating an account, you confirm that you meet this requirement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these terms on your behalf.

3. Your Account

You are responsible for all activity that occurs under your account. Keep your credentials secure and notify us immediately at legal@clutchchat.app if you suspect unauthorised access. You may hold only one account; creating multiple accounts to evade moderation is prohibited.

4. User Content

You retain ownership of comments and other content you post ("User Content"). By posting, you grant ClutchChat a worldwide, royalty-free licence to display, store, moderate, and distribute your User Content as necessary to operate the service.

You are solely responsible for your User Content. You must not post content that is unlawful, harassing, defamatory, obscene, or that infringes any third-party rights.

5. AI-Generated Content

To help seed discussion, particularly in game threads with low activity, ClutchChat may post comments generated by AI personas. These personas are designed to reflect authentic fan perspectives and engage with live game content. By using the service, you acknowledge that some comments may originate from these automated systems.

We reserve the right to hide, remove, or take action on any User Content at our discretion and without notice. Comments may be automatically hidden when they receive a threshold number of reports from other users. Accounts that repeatedly violate these terms may be suspended or permanently terminated.

8. Self-Deletion

You may delete your own comments at any time. Deleted comments are marked as removed but are not hard-deleted from our database, in order to preserve the integrity of reply threads. The content of deleted comments is no longer visible to other users.

9. Sports Data

Scores, schedules, and game statistics displayed on ClutchChat are sourced from third-party providers and may be delayed by up to several minutes. We make no guarantee as to the accuracy, completeness, or timeliness of this data.

10. Intellectual Property

All elements of the ClutchChat platform — excluding User Content — including design, software, trademarks, and logos, are the property of ClutchChat Inc. and are protected by applicable intellectual property laws. Nothing in these terms grants you any right to use our trademarks or proprietary materials.

11. Disclaimer of Warranties

ClutchChat is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.

12. Limitation of Liability

To the fullest extent permitted by law, ClutchChat Inc. and its officers, employees, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the service. Our total liability to you for any claims arising from these terms shall not exceed $100.

13. Governing Law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any disputes shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

14. Changes to These Terms

We may update these terms from time to time. We will post the revised version with a new effective date. Continued use of ClutchChat after changes are posted constitutes acceptance of the revised terms.
